FIRST, OUR COMMUNITY IS GROANING FROM WITHIN ON THE STRESSFUL LOAD ON THE SCHOOL DISTRICT THAT MUST BUILD MORE AND MORE SCHOOLS TO HOUSE THE MASSIVE INFLUX OF STUDENTS PREDICTED ONE PER YEAR FOR THE NEXT TEN YEARS. THIS PUTS A BURDEN ON THE TAXPAYERS FOR MORE SCHOOL BONDS THAT WE JUST HAD WITH THIS TREMENDOUS GROWTH. THERE IS CONSTRUCTION EVERYWHERE ALONG THE ROADS WITH ROADS TORN UP, DETOURS TEARING UP YARDS FOR MORE WATER LINES, POWER LINES, SEWER LINES AND FIBER OPTICS AND THINGS ALONG THAT SORT. IT'S DEALT WITH DIFFERENTLY THAN WE DO THE OTHER PIDS THAT HAVE TIRZ AND THE KEY POINTS I BELIEVE THAT ARE IMPORTANT TO NOTICE IS THAT THE STAFF NEGOTIATED PERFORMANCE TIMEFRAMES AND FINANCIAL PENALTIES IF THE LAGUNA WASN'T BUILT IN TIME AND DELIVERED. AND SO THIS, I BELIEVE, THE 380 AGREEMENT. IS CONSISTENT WITH THE FINANCIAL CONSTRAINTS AND BENCHMARKS THAT WERE PUT IN THE DEVELOPMENT AGREEMENT. AND THIS PROTECTS THE CITY AND CITIZENS AND PROVIDES A SIGNIFICANT FINANCIAL INCENTIVE FOR THE DEVELOPER TO MAKE SURE THAT'S DONE IN TIME. SO AS YOUR FINANCIAL ADVISOR, I THINK WE ARE 100% SUPPORTIVE. WE'RE INVOLVED IN SOME ASPECTS OF THE NEGOTIATION AND WE'D RECOMMEND APPROVAL. MR. SABONIS CAN JUST ADD ONE THING. THIS TIRZ ACTUALLY REIMBURSES DEVELOPER FOR COSTS FROM FROM AD VALOREM TAXES A PERCENTAGE OF THOSE TAXES. BUT THE REAL BENEFIT AND THE REAL ECONOMIC BENEFIT DRIVER ON THESE PROJECTS IS SALES TAX. FAR MORE SALES TAX WILL BE GENERATED THAN AD VALOREM. AND SO AGAIN, THE POINT BEING IS THAT IF IT'S BUILT AND IT'S GOT VALUE AND THERE'S TAXES THAT WE COLLECT FOR THAT, WE WOULDN'T WANT TO BE IN A POSITION WHERE WE REIMBURSE THEM THOSE TAXES FOR THE TOURS IF WE'RE NOT RECEIVING SALES TAX BENEFIT FROM THE PROJECT. WHEN YOU LOOK AT WHERE THE VALUE REALLY COMES TO A COMMUNITY, IT'S DIFFERENT THAN RESIDENTIAL BECAUSE MOST OF THE ECONOMIC VALUE, IT'S MUCH DENSER ON THE SALES TAX BASIS. AND SO THE GOAL HERE WAS, IS A STRATEGIC GOAL OF THE CITY IS TO PROVIDE ENTERTAINMENT, DESTINATION FOR THE LAGUNA AND THE RESTAURANTS AND TO GENERATE SALES TAX TO TAKE THE BURDEN OFF OF AD VALOREM TAXPAYERS OF CITIZENS AND BUSINESSES. AND SO THE GOAL THAT WE HAVE HERE IS FOR A PERIOD OF TIME WILL BE REBATED 80% OF THEIR AD VALOREM TAXES. AT THE SAME TIME, BASED ON OUR ANALYSIS, THE SALES TAX WOULD GENERALLY BE FAR GREATER THAN THAT. AND SO NO MONEY COMES OUT OF THE COFFER OF THE CITY, AND THE ONLY MONEY THAT'S REIMBURSED THEM IS A PERCENTAGE OF THE MONEY THAT THEY PAY. SO IT'S A RISK FREE SITUATION FOR THE CITY. NOW, THE ONLY RISK WE HAVE IN THIS PROJECT WAS, AGAIN, IS THE PROJECT GOING TO BE BUILT ON TIME. IT'S A UNIQUE PROJECT AND WILL STAY OPEN FOR THAT PERIOD OF TIME. AND SO AS I INDICATED, WHILE WE HAD THE FINANCIAL GENERAL NUMBERS WORKED OUT, THERE WAS A LOT OF DISCUSSION BY THE CITY AND ITS LEGAL ADVISORS TALKING TO THE DEVELOPER ABOUT YOU MUST OPEN IN TIME IF WE'RE GOING TO PUT THIS IN PLACE AND IF YOU CLOSE FOR AN EXTENDED PERIOD OF TIME DURING THE TIMEFRAME, WE DON'T WANT TO BE ABLE TO DO THIS. THE DEVELOPER INSTALLED IMPACT FEE ELIGIBLE INFRASTRUCTURE PER THE DEVELOPMENT AGREEMENT. SPECIFICALLY, HE INSTALLED OVERSIZE WATER LINES, WASTEWATER LINES FOR FUTURE GROWTH. THAT WAS PART OF THE ORIGINAL NEGOTIATIONS. THE CITY PAYS IN ACCORDANCE WITH CHAPTER 385 OF THE TEXAS LOCAL GOVERNMENT CODE CREDITS TO THE DEVELOPER. WHEN THE DEVELOPER CONSTRUCTS CAPITAL IMPROVEMENTS ON OUR ON OUR ADOPTED CAPITAL IMPROVEMENT PLAN AND ONLY FROM THE RESTRICTED IMPACT FEE ACCOUNTS SPECIFICALLY FOR THAT PURPOSE.
