SO THERE'S THIS ONE COMING UP. SO DRONE DELIVERIES ARE BECOMING MORE AND MORE PREVALENT. IN FACT, WE'RE STARTING TO SEE THOSE IN PLANO AND RECENTLY NORTH RICHLAND HILLS APPROVED TWO DRONE TAKEOFF FACILITIES. WALMART HAS ANNOUNCED THEY'RE INTENDING TO HAVE DRONE DELIVERIES FOR ALL OF THE 30 CITIES THAT THEY OPERATE IN IN THE NORTH TEXAS AREA. WITH THAT COMES SOME CONCERNS. YOU KNOW, WHAT CAN WE DO? WHAT CAN'T WE DO? WE HAVE BEEN APPROACHED BY THE PRINCETON WALMART ABOUT THEIR INTENT TO MOVE FORWARD WITH DRONE DELIVERIES IN OUR COMMUNITY. BEFORE THAT COMES FORWARD, WE THOUGHT IT WOULD BE GOOD TO HAVE A CONVERSATION ABOUT WHAT WE CAN AND CAN'T REGULATE. AND WITH THAT, I WOULD LIKE TO BRING OUR ASSISTANT CITY ATTORNEY WHO'S GOING TO TALK ABOUT SOME REGULATORY CONSIDERATIONS. SO, AS JOHN MENTIONED IN HIS LITTLE INTRODUCTION, THERE ARE THERE'S AN EMERGENCE OF DRONE DELIVERIES ACROSS NORTH TEXAS. YOU KNOW, MANY RETAILERS SUCH AS WALMART, AMAZON, ETC., ARE DESIRING TO UTILIZE DRONES. OR ALSO REFERRED TO AS UNMANNED, UNCREWED ROTARY WING AIRCRAFT. SO A LOT OF WORDS THERE TO DELIVER PRODUCTS TO CUSTOMERS WHAT THEY TYPICALLY DO. NOW AMAZON IS MAYBE LOOKING AT A DIFFERENT MODEL, BUT THEY TYPICALLY PARTNER WITH OTHER COMMERCIAL DRONE DELIVERY COMPANIES, SUCH AS SOME OF THE BIG ONES BEING WING, FLYTREX AND ZIPLINE. DRONE UP SOME OF THOSE MENTIONED ON THE SLIDE. TYPICALLY THESE RETAILERS ARE LOOKING AT DOING DRONE DELIVERIES FOR THE LAST MILE DELIVERY. SO THINK LIKE FROM THE WALMART STOREFRONT TO SOMEONE'S FRONT DOOR OR FROM A WAREHOUSE TO THEIR FRONT DOOR. SO IT'S NOT, YOU KNOW, THEY'RE NOT LOOKING AT GOING A HUGE STRETCH FROM THE DELIVERY POINT TO THE HOUSE. JUST, YOU KNOW, THAT LAST MILE OR TWO FOR EFFICIENCIES AND FEASIBILITY. SO SOME OF THE CONCERNS YOU KNOW, AS JOHN MENTIONED, OTHER CITIES, PLANO, NORTH RICHLAND HILLS, ETC. HAVE ADOPTED SIMILAR REGULATIONS. SOME OF THE CONCERNS THAT RESIDENTS RAISED AT THOSE CITIES ARE COMING IN THE FORM OF NOISE AND PRIVACY CONCERNS. SO I'LL KIND OF ADDRESS SOME OF THOSE IN THE NEXT SLIDES AND SHOW YOU WHAT THE CITY CAN AND CANNOT REGULATE SHOULD THEY CHOOSE TO MOVE FORWARD WITH A DRONE DELIVERY ORDINANCE. SO THANK YOU. AMBER. SO THE FIRST PART IS WHAT MUNICIPALITIES CAN REGULATE. SO THINK ABOUT LAND USE IN TERMS OF WHAT WE CAN REGULATE. SO THE SIZE AND LOCATION OF THE DRONE DELIVERY HUB. YOU CAN LIMIT THE SIZE OF THE HUB TO A PERCENTAGE OF THE TOTAL LOT OR SQUARE FOOTAGE. YOU CAN ALSO HAVE CERTAIN SETBACK REQUIREMENTS, WHETHER IT BE, YOU KNOW, 300FT, 500FT FROM A QUIET ZONE OR FROM A RESIDENTIAL NEIGHBORHOOD. YOU CAN ALSO ENFORCE SOME OF YOUR SCREENING REQUIREMENTS. I KNOW THE CITY HAS SOME SCREENING REQUIREMENTS THAT THEY REQUIRE SOLID MASONRY, REINFORCED CONCRETE OR VINYL MATERIAL SCREENING TO MAKE IT YOU KNOW, MORE ATTRACTIVE TO LOOK AT. YOU CAN ALSO, TO SOME EXTENT REGULATE THE NOISE SO WE CAN ENFORCE OUR NOISE ORDINANCE. YOU CAN ALSO BY IMPLEMENTING THAT THE SETBACK REQUIREMENTS AND THE SCREENING REQUIREMENTS WILL HELP CUT BACK ON THE NOISE A LITTLE BIT. SO JUST AS A LITTLE EXAMPLE, TYPICALLY DRONES OPERATE AT BETWEEN 150 AND 200FT IN THE AIR. THEY CAN'T GO ABOVE 400FT PER FAA REQUIREMENT. SO THEY'RE USUALLY WITHIN THAT AREA. SO WHEN A DRONE TAKES OFF AT ZERO FEET, SO FROM THE GROUND GOING UP, THE NOISE IS OBVIOUSLY THE LOUDEST BECAUSE THEY'RE CLOSEST TO THE GROUND. [00:05:08] THE NOISE IS USUALLY AROUND 80DB. SO THAT'S THE EQUIVALENT OF A LIKE A GARBAGE DISPOSAL. SO I'M JUST KIND OF GIVING YOU SOME OF THESE EXAMPLES BECAUSE SOME OF THESE CONCERNS MAY BE RAISED. AT TAKEOFF AT APPROXIMATELY 50FT IN THE AIR IS AROUND 75DB. SO THAT'S THE EQUIVALENT OF MAYBE AN ALARM CLOCK. AND THEN TAKING OFF 150FT AWAY IS THE EQUIVALENT OF TRAFFIC NOISE OR A VACUUM CLEANER DRONE, WHEN THEY'RE IN THE AIR AT THAT AVERAGE HEIGHT OF ABOUT 200FT. IT'S THE EQUIVALENT OF JUST LIKE NORMAL TALKING, NORMAL, NORMAL SPEECH. AND THAT'S ABOUT 60 TO 65DB. AND THEN DRONE TAKE OFF AT 500FT AWAY. SO IF YOU HAVE A 500 FOOT SETBACK, IT'D BE THE EQUIVALENT OF A DISHWASHER OR NORMAL CONVERSATION. SO I JUST WANT TO KIND OF GIVE YOU SOME OF THOSE POINTS TO KEEP IN MIND. SO MOVING ON TO WHAT MUNICIPALITIES CANNOT REGULATE, WE CANNOT REGULATE THE OPERATION OF DRONES. SO THAT'S ACTUALLY EXPRESSLY PROHIBITED UNDER CHAPTER 423 OF THE LOCAL GOVERNMENT CODE. EXCUSE ME, THE GOVERNMENT CODE UNLESS WE'RE USING DRONES FOR A CITY EVENT OR FOR SOME MUNICIPAL PURPOSE, WE CANNOT REGULATE THE OPERATION OF DRONES. ONCE THEY'RE IN THE AIR, THAT BECOMES A FEDERAL REGULATION UNDER THE FAA. SO WE CAN'T LIKE I MENTIONED, WE CAN'T IF IT'S OPERATIONAL REGULATIONS, WE CAN'T ENFORCE IT. SO THE NUMBER OF FLIGHTS, THE FLIGHT PATHS, THE FLIGHT ALTITUDE, FLIGHT SPEED, WE CANNOT REGULATE THAT. SO IN TERMS OF THE PRIVACY CONCERNS, THERE ARE STATE LAW OFFENSES FOR INVASIVE VIDEO RECORDING THAT'S PUNISHABLE UNDER THE PENAL CODE. AND THERE'S ALSO CERTAIN MISDEMEANORS FOR INVASIVE VIDEO RECORDING. SO KEEP THAT IN MIND. AND THAT'S LIKE I SAID THAT'S FROM THE STATE LEVEL. SO THERE ARE PENALTIES IF PEOPLE ARE IF, YOU KNOW, IF DRONES ARE BEING USED FOR OTHER PURPOSES. SO MY UNDERSTANDING OF THE DRONES IS THAT USED FOR THIS TYPE OF DELIVERY IS THAT THEY HAVE THEY DO HAVE CAMERAS. SO THAT QUESTION WILL BE ASKED. THEY DO HAVE CAMERAS, BUT THE CAMERAS ARE USUALLY THEIR NAVIGATIONAL AND FOCUS. RIGHT. SO THEY DON'T THEY'RE NOT THEY DON'T ZOOM IN AND THEY'RE USUALLY LOW RESOLUTION. THEY'RE USUALLY USED JUST TO NAVIGATE. BUT ONCE AGAIN WE CAN'T REGULATE THE OPERATION OF THE DRONE JUST WHERE THEY LAND AND TAKE OFF. YOU KNOW, ALSO OBVIOUSLY SAFETY AND TRAINING REQUIREMENTS AND THE CONTENTS OF DELIVERIES, WE CAN'T, CAN'T REGULATE THAT. SO ARE THERE ANY QUESTIONS BEFORE I MOVE ON TO NEXT STEPS? OKAY. AWESOME. WALMART'S WANTING TO PUSH IT TO ALL THEIR 30 LOCATIONS. SO THE THOUGHT IS THIS IS KIND OF A NEWER IDEA, A NEW, NEWER PROCESS, NEWER TECHNOLOGY. THE THOUGHT IS TO KIND OF BE PROACTIVE AND NOT REACTIVE AND PUT CERTAIN REGULATIONS IN PLACE. SO THAT WAY WHEN A CURRENT RETAILER OR A FUTURE RETAILER COMES KNOCKING AND ASKING, WE ALREADY HAVE THE REGULATIONS IN PLACE. SO THAT WAY WE CAN ADDRESS SOME OF THE NOISE AND THE PRIVACY CONCERNS THAT THE RESIDENTS MAY HAVE. BECAUSE, YOU KNOW, A LOT OF MUNICIPALITIES ARE SLOWLY STARTING TO REGULATE WHAT THEY CAN BECAUSE OF THIS NEW TECHNOLOGY. SO LIKE I SAID, IT'S BEST TO BE PROACTIVE IN MY OPINION AND NOT REACTIVE AND KIND OF YOU KNOW, I KNOW PRINCETON WANTS TO BE A LEADER, AND THIS IS ANOTHER AREA WHERE WE CAN BE A LEADER AND KIND OF SET THE PRECEDENT. SO WITH THAT BEING SAID, THE NEXT STEPS WOULD BE THIS WOULD REQUIRE A ZONING ORDINANCE AMENDMENT TO THE TEXT. SO WE WOULD HAVE TO FOLLOW THE NOTICE AND PUBLIC HEARING REQUIREMENTS GO BEFORE THE P AND Z AND COUNCIL. AND DISCUSSING THIS WITH STAFF, THE RECOMMENDATION, YOU KNOW, SHOULD WE KIND OF OBTAIN YOUR, YOUR APPROVAL TO MOVE FORWARD WITH BRINGING SOMETHING BACK FOR POSSIBLE CONSIDERATION WOULD BE TO ALLOW COMMERCIAL DRONE DELIVERY HUBS, AND THAT WOULD BE DEFINED WITHIN THE ZONING ORDINANCE IN THE CITY'S NON RESIDENTIAL DISTRICTS ONLY, SO NOT IN RESIDENTIAL DISTRICTS AND ALSO REQUIRE AN SUP. SOME CITIES ALLOW IT AS A RIGHT. BUT I THINK YOU KNOW AS THIS IS A NEWER PROCESS HAVING AN SUP TO WHERE THEY HAVE TO, YOU KNOW, EVERY, EVERY RETAILER THAT WANTS TO COME IN AND HAVE A DRONE DELIVERY HUB WOULD HAVE TO REQUEST AN SUP AND GO THROUGH THE PROCESS. BY DOING THAT, WE WOULD UPDATE THE ZONING USE CHART TO ALLOW COMMERCIAL DELIVERY HUBS AS AN AUTHORIZED ZONING USE CLASSIFICATION, AND ALSO MAKE SURE WE DISTINGUISH BETWEEN UNMANNED OR DRONES AND MANNED OR HELICOPTERS, BECAUSE RIGHT NOW, YOUR ZONING ORDINANCE CURRENTLY ALLOWS FOR HELI [00:10:07] STOPS AND HELIPORTS. SO JUST MAKING SURE THAT WE DISTINGUISH BETWEEN THE TWO THE HELI STOPS ARE PERMITTED OR PERMITTED USE IN YOUR M1 AND M2 DISTRICTS AND VIA SGP IN YOUR NEIGHBORHOOD. CONVENIENCE. LIGHT COMMERCIAL AND GENERAL COMMERCIAL. AND THEN HELIPORTS ARE ALLOWED VIA SGP AND GENERAL COMMERCIAL, LIGHT MANUFACTURING, INDUSTRIAL AND HEAVY MANUFACTURING, INDUSTRIAL. HOWEVER, BECAUSE DRONES ARE STARTING TO BECOME A NEWER TECHNOLOGY, AND EVEN THE FAA, THEY'RE BATTLING WITH SOME OF THEIR REGULATIONS ON DRONES. THERE COULD BE AN ARGUMENT THAT, YOU KNOW, IT COULD FALL UNDER A HELICOPTER OR HELISTOP. SO I THINK MAKING SURE OUR ZONING ORDINANCE IS VERY, VERY CLEAR. AND THAT WAY WE HAVE, YOU KNOW, THE CERTAIN REGULATIONS FOR THE DRONES WOULD BE IDEAL. LIKE I SAID, TO TRY TO GET AHEAD OF IT AND NOT BE REACTIVE, BE PROACTIVE. SO ARE THERE ANY MORE QUESTIONS. THERE'S GOING TO BE NOISE INVOLVED, AND IT'S NOT GOING TO BE A VIOLATION OF OUR NOISE ORDINANCE, BUT IT'S GOING TO BE A DIFFERENT NOISE. SO IT'S GOING TO YOU'RE GOING TO BE I DON'T KNOW IF YOU'VE EVER HEARD A DRONE FLY BEFORE, BUT IT KIND OF GETS YOUR ATTENTION BECAUSE YOU'RE NOT USED TO HEARING THAT. AND THE CAPITAL IMPROVEMENT PLAN AND THE IMPACT FEE PLANS THAT WE USE TO BASE OUR INFRASTRUCTURE PROGRESSION ON, WERE DESIGNED FOR A MUCH LESS DENSE POPULATION THAN WHAT WE ARE EXPERIENCING NOW. AND WHILE THE AREAS OF CULLEOKA DO NOT COUNT TOWARDS THE SERVICE POPULATION WITHIN THE CITY OF PRINCETON, THEY ARE PUTTING A STRAIN ON OUR INFRASTRUCTURE AND WE ARE FEELING THAT STRAIN. WE ARE ALSO HAVE A LARGE PUMP STATION PROJECT THAT'S UNDERWAY RIGHT NOW THAT IS SIGNIFICANTLY DECREASED OUR PUMPING CAPACITIES. WE DO HAVE THE PUMPING CAPACITY TO MEET CURRENT DEMANDS, BUT AS THE AS IT PROGRESSES, THAT NUMBER IS GOING TO BECOME TIGHTER AND TIGHTER. SO WITH THE MORATORIUM, WE'RE LOOKING FOR A LITTLE BIT OF BREATHING ROOM, SOME TIME TO REEVALUATE HOW WE'RE GROWING, WHERE WE'RE GROWING, AND HOW WE'RE GOING TO CONTINUE TO GROW INTO THE FUTURE. SO BASED ON CURRENT POPULATION COUNTS, WE'RE ESTIMATED TO HIT THAT POPULATION THRESHOLD IN LESS THAN FIVE YEARS. AND SO WHAT WOULD THE MORATORIUM IS GOING TO DELAY SOME OF THE GROWTH, JUST ENOUGH FOR US TO GET THE DESIGN AND, AND EVERYTHING THAT WE NEED FOR OUR STORAGE TANK PROJECTS TO PUSH THOSE OUT SO THAT WE CAN MEET THE FUTURE DEMANDS. AND IT'S ALSO GOING TO GIVE US A LITTLE BIT OF BREATHING ROOM TO GET A STEP FORWARD ON OUR CAPITAL IMPROVEMENT PLAN AND OUR IMPACT FEE PROJECTS, WHICH WE'RE ALSO DEVELOPING RIGHT NOW. THE ROADWAY INFRASTRUCTURE IS ALSO FEELING THE STRAIN, AS ANYBODY THAT PASSES THROUGH TOWN CAN TELL YOU 380 AND ALL OF THE ROADWAYS THROUGHOUT THE CITY ARE VERY CONGESTED. SO WE ARE ALSO LOOKING WITH OUR ENGINEERING TEAM TO REEVALUATE OUR ROADWAY SYSTEM. WE'RE GOING TO PERFORM A FULL ANALYSIS OF OUR ROADWAYS THROUGHOUT THE CITY. WE'RE GOING TO LOOK AT OUR SIDEWALK AND TRAIL GAP. ANALYSIS OF SAFETY AND MOBILITY IS KEY AND HOW WE GET PEOPLE THROUGH THE TOWN. AND SO AS WE'RE DEVELOPING THESE PLANS, IF THE DEVELOPMENT CONTINUES AT THE RATE THAT IT IS CURRENTLY WE'RE GOING TO BE CONSTANTLY DESIGNING FOR SOMETHING THAT WE'RE CHASING. SO IF WE CAN KIND OF PUSH THAT OFF JUST A LITTLE BIT, IT WILL ALLOW US TO GET AHEAD OF IT. AND WITH THAT, I'LL PASS IT OFF TO POLICE CHIEF WALTERS. MADAM. MAYOR. COUNCIL MEMBERS. WE LOOK AT REVISING OUR COMPREHENSIVE PLAN ZONING ORDINANCES, SUB SUBDIVISION ORDINANCES, AND ALSO CAPITAL IMPROVEMENT PLANS. NEXT SLIDE. SO THE DURATION OF THE MORATORIUM IS 120 DAYS POST ADOPTION. ONCE AGAIN, THIS TIME FRAME IS SET UNDER STATE LAW AND IT CAN BE EXTENDED THEREAFTER AS LONG AS YOU FALL ONCE AGAIN THE NOTICE AND PUBLIC HEARING REQUIREMENTS AND IDENTIFY THE PROBLEM WHICH YOU KNOW THE PROBLEM WOULD STILL NEED TO EXIST, AND KIND OF DETAIL SOME OF THE PROGRESS THAT THE CITY HAS MADE, AND YOU CAN EXTEND IT THEREAFTER FOR DEFINITE PERIODS UNTIL THE PROBLEM IS ADDRESSED.
