LORD, WE'RE SO THANKFUL TO LIVE IN A FREE COUNTRY WHERE WE CAN COME TOGETHER AND DISCUSS WHAT NEEDS TO HAPPEN IN OUR CITY AND OUR GOVERNMENTS.

LORD, DURING THIS TIME OF YEAR, ESPECIALLY DURING THIS ELECTION TIME, WE JUST PRAY THAT YOU WILL GUARD OVER THAT PROCESS AND PUT THE RIGHT PEOPLE IN PLACE AND IN OUR NATIONAL GOVERNMENT AND OUR STATE GOVERNMENTS AND LORD, HERE IN OUR LOCAL GOVERNMENT FOR OUR SCHOOL BOARDS.

LORD, WE PRAY THAT YOU RAISE UP THE WISE COUNSEL THAT WILL CONTINUE TO HELP THE CITY AND THE SCHOOL TO GROW AND PROSPER.

LORD, I PRAY THAT AS WE GROW IN NUMBER, WE WILL ALSO GROW IN LOVE AND UNITY AND IN PEACE.

LORD, THAT THE THINGS THAT WE ALL VALUE, THE THINGS OF JOY, THE THINGS OF LIFE AND LIBERTY AND LOVE, THOSE WILL BE THE THINGS THAT WILL BE FIRST ON OUR HEARTS AND ON OUR MINDS, BECAUSE THOSE ARE THE THINGS THAT MAKE A COMMUNITY.

PUT ON THE ON MY SHEET THERE THAT I INTENDED TO SPEAK ABOUT SEVERAL ITEMS IN THE PUBLIC COMMENT SECTION, THE 179 ACRES AND THE WYNDMOOR REVISION PROJECT. IS THAT GOING TO BE? SHOULD I WAIT? AND DURING THAT PUBLIC HEARING SECTION? SURE. OKAY.

SO IN GENERAL, THEN I'D LIKE TO USE MY 30 MY THREE MINUTES TO SPEAK ABOUT TWO ISSUES.

ONE IS TRANSPARENCY.

SO AGAIN, WE HAVE WE HAVE BROUGHT UP THE SAFEGUARD PRINCETON AND THE HOME RULE CHARTER AMENDMENTS WE'D LIKE TO SEE.

AND ONE OF THE ISSUES IS JUST TRANSPARENCY AND THIS WHOLE PROCESS.

SO THINGS ARE HAPPENING SO FAST HERE THAT THERE'S IT'S NEARLY IMPOSSIBLE FOR CITIZENS TO KEEP UP WHEN YOU PUT AN AGENDA ITEM ON, IN THIS CASE, SOME OF THE THINGS YOU PUT ON A MONDAY.

OKAY. BUT EVEN AT THAT, IT'S VERY HARD TO KEEP UP.

AND THEN SOME OF THE DOCUMENTS WE MIGHT WANT, LIKE SAY, A DEVELOPMENT AGREEMENT, FOR EXAMPLE, IS NOT AVAILABLE.

SO THAT HAS TO BE OBTAINED.

OKAY. SO IT WOULD BE NICE IF, IF WE HAD A TWO WEEK WORKING PERIOD AND IT WOULD TAKE ONE, ONE, BASICALLY ONE TRANSITION PERIOD TO ACCOMPLISH THAT.

SO THERE MIGHT BE A LITTLE BIT OF HESITATION AT THE FIRST, BUT THEN EVERY TWO WEEKS IT'S FLOWING.

IT WOULD ALLOW THE PUBLIC TO THE OPPORTUNITY TO BE A LOT MORE ENGAGED.

AND SO AND ALSO ITEMS OF PARTICULAR INTEREST, LIKE FOR EXAMPLE DEVELOPMENT AGREEMENTS, THINGS LIKE THAT

IT'S IN REGARD TO THE COMMERCIAL DRONE DELIVERY.

IF THE COUNCIL APPROVES THE ZONING ORDINANCE TONIGHT, AND LET'S SAY A YEAR FROM NOW, A SAFETY NUISANCE, A SAFETY OR NUISANCE CONCERN DEVELOPS THAT WASN'T FORESEEN AT THIS MOMENT IN TIME.

WOULD ANY CHANGE, WOULD ANY CHANGE IN THE ZONING ORDINANCE TO CORRECT THESE CONCERNS APPLY TO THE DRONE COMPANIES THAT ARE ALREADY ESTABLISHED AND OPERATING IN THE CITY, OR WOULD THEY BE GRANDFATHERED AND EXEMPT FROM ANY NEW ZONING REQUIREMENTS? TAKE SOME ADVICE FROM SOMEBODY THAT HAS LIVED ON THE SAME PROPERTY FOR 52 YEARS THAT MY GREAT GRANDFATHER PURCHASED BACK IN THE EARLY 30S.

I ONLY EXIST TODAY BECAUSE OF THE GRANDFATHER CLAUSES THAT ARE BUILT INTO OUR LOCAL, COUNTY AND STATE RULES AND REGULATIONS.

I BELIEVE THIS TECHNOLOGY IS COMING, BUT WE HAVE TO BE SMART, AND WE'VE GOT TO GET IT RIGHT.

I DON'T WANT SOME DRONE FLYING BY.

IF I WANTED TO DO THAT, I'D BE IN THE FRONT YARD.

SO PRIVACY IS A BIG THING.

WE DON'T KNOW WHO'S ON THE OTHER SIDE OF THOSE DRONES.

YES, WE KNOW.

SO THE DRONES ARE MEANT JUST TO DELIVER STUFF AND DROP IT OFF.

BUT WE ALL KNOW THE WORLD DOESN'T WORK THAT WAY.

WE DON'T KNOW WHO'S ON THE OTHER SIDE OF THE DRONE.

WE DON'T KNOW WHAT THEY'RE DOING.

I DID LOOK IT UP ON INDEED THE AVERAGE DELIVERY DRIVER HERE MAKES ABOUT $18 AN HOUR.

THOSE JOBS ARE GOING TO BE GONE.

AND SO THOSE JOBS IN PRINCETON ARE OVER ONCE YOU BRING THOSE DRONES.

A LOT OF THOSE A LOT OF THOSE PEOPLE ARE DEPENDING ON THOSE JOBS.

THOSE ARE PART TIME JOBS AND THAT'S HOW THEY'RE MAKING THEIR BILLS.

ANOTHER ONE WAS WHO'S RESPONSIBLE IF SOMETHING GOES WRONG WITH THE DRONE? I MEAN, NOT ONLY IS IT GOING TO BE NOISE, BUT IF YOU JUMP UP, IF MY DOG JUMPS UP AND EATS IT, WHO'S GOING TO PAY FOR IT? AND THEN THE BIRDS.

THE BIRDS ARE MY BIG ONE.

IT'S ALREADY BEEN PROVEN THAT IT DISRUPTS THEIR NESTING THAT THEY WILL LEAVE THEIR NESTS AND THEIR EGGS.

IT'S ALSO SHOWN THAT THEY HAVE ATTACKED THE DRONES.

AND SO THERE'S STILL A LOT MORE THAT NEEDS TO BE INVESTIGATED AS FAR AS THE BIRDS AND THE INSECTS, TOO, BECAUSE THERE HAS BEEN REPORTS OF THE INSECTS BEING DRAWN TO THE DRONES.

SO ANYWAY, THAT'S ALL I HAD TO SAY ABOUT DRONES, AND I JUST WANTED TO SAY ABOUT THE MORATORIUM.

I KNOW YOU GUYS DID THAT CLAUSE IN THERE THAT IF THEY HAD APPLIED FOR IT, BUT WE DON'T NEED ANY MORE HIGH DENSITY HOUSES.

WE DON'T NEED ANY MORE RENTAL HOMES.

THE PURPOSE OF THIS ORDINANCE IS TO CLEAN UP THE LAND USE CHART TO CORRECT A DISCREPANCY, AND TO UPDATE THE CHART FOR SOME CLARIFICATION.

IT'S PROPOSED TO MODIFY THE FOLLOWING LAND USES.

CONVENIENCE STORE WITH GAS PUMPS, PUBLIC SCHOOL, HOTEL, MOTEL, AND IN-HOME DAYCARES.

SO THE CITY'S LAND USE CHART.

IT LISTS ALL OF THE ZONING DISTRICTS AND THEN ALL OF THE LAND USES AND WHETHER THOSE USES ARE PERMITTED, REQUIRE AN SUP OR A CONDITIONAL USE, OR ARE A PROHIBITED USE.

SO THE PROPOSED CHANGES TONIGHT.

FIRST, REGARDING CONVENIENCE STORES.

THIS IS TO CLEAN UP A DISCREPANCY.

THE EXISTING LANGUAGE.

CONVENIENCE STORES WITH A FUEL PUMP REQUIRE AN SUP IN ALL OF OUR NONRESIDENTIAL ZONING DISTRICTS.

BUT IF YOU LOOK AT THE C-1 DISTRICT STANDARDS, IT CLEARLY INDICATES THAT A GAS STATION IS A PERMITTED USE.

SO WE HAVE A CONFLICT.

SO I'M PROPOSING TO ALLOW FOR CONVENIENCE STORES IN THE COMMERCIAL ZONING DISTRICTS IN C1 AND C2 BY.

RIGHT. THAT'S JUST TO CLEAN UP THAT LANGUAGE.

SO C1 AND C2 ARE TWO MAIN COMMERCIAL DISTRICTS ALONG US 380.

WE HAVE MANY GAS STATIONS EXISTING IN THESE DISTRICTS AND PROPOSING THAT THEY BE AN ALLOWED USE BY RIGHT, RATHER THAN REQUIRING A SPECIFIC USE PERMIT.

THE SECOND USE OF PROPOSED TO CHANGE IS THE PUBLIC SCHOOLS.

THOSE CURRENTLY REQUIRE AN SUP IN JUST ABOUT EVERY ZONING DISTRICT.

I IN MY OPINION, I DON'T THINK THAT'S NECESSARY TO REQUIRE A SPECIFIC USE PERMIT.

JUST LOOKING TO MAKE THE ENTITLEMENT OR DEVELOPMENT PROCESS A LITTLE BIT BUT SIMPLER FOR THE SCHOOL DISTRICTS.

THE PROPOSAL IS TO ALLOW THOSE USE SCHOOL DISTRICT.

THE SCHOOLS EXCUSE ME TO BE BUILT BY RIGHT IN RESIDENTIAL DISTRICTS.

THIRD, PROPOSED CHANGES REGARDING A HOTEL OR MOTEL USE THAT CURRENTLY REQUIRES AN SUP AND C1 AND IS PERMITTED IN C2.

STAFF'S RECOMMENDATION IS TO ALLOW FOR HOTELS BY RIGHT IN C1 AND CONTINUE THAT ALLOWED BY RIGHT IN C2, AND THEN ALLOW FOR AN SUP AND M-1, WHICH IS OUR LIGHT INDUSTRIAL ZONING DISTRICT.

THE PLANNING AND ZONING COMMISSION RECOMMENDED APPROVAL OF THIS ITEM WITH KEEPING THE HOTEL AS A SPECIFIC USE PERMIT AGAINST STAFF'S RECOMMENDATION.

FOURTH ITEM OR LAND USE LOOKING TO CHANGE IS CHILDCARE IN-HOME CHILDCARE? CURRENTLY REQUIRES AN SUP IN MANY OF OUR SINGLE FAMILY ZONING DISTRICTS.

WE GET A LOT OF REQUESTS FOR IN-HOME DAYCARE.

IT'S A HIGHLY SOUGHT AFTER OR REQUESTED USE.

WE HAVE A GREAT NEED FOR THAT IN THE COMMUNITY.

SO WE'RE LOOKING TO TO SIMPLIFY THAT PROCESS.

GENERALLY, IN-HOME DAYCARES ARE NOT CONTROVERSIAL.

SO IN MY TENURE AS A DIRECTOR, WE'VE HANDLED A FEW OF THOSE.

WE'VE NEVER HAD ANY COMPLAINTS ABOUT THEM.

SO WE'RE LOOKING TO MAKE THAT A CONDITIONAL USE THAT AS LONG AS THE BUSINESS OWNER AGREES TO MEET ALL THE STANDARDS OF THE CITY'S HEALTH CODE, THE CITY'S FIRE CODE, THAT WE WILL THEN BE ABLE TO ISSUE A PERMIT WITHOUT HAVING TO GO THROUGH THE PUBLIC HEARING PROCESS BEFORE THE PLANNING AND ZONING COMMISSION AND CITY COUNCIL.

SO IT'S THE IN-HOME DAYCARES WOULD STILL HAVE TO ADHERE TO THE CITY'S CODES, BUT THEY WOULDN'T HAVE TO GO THROUGH THAT BURDENSOME PROCESS OF PUBLIC HEARINGS.

SO THOSE ARE THE FOUR CHANGES THAT HAVE BEEN PROPOSED.

THESE ITEMS WERE RECOMMENDED FOR APPROVAL BY THE PLANNING AND ZONING COMMISSION, WITH THE EXCEPTION OF THE HOTEL MOTEL.

LIKE OTHER DEVELOPMENTS IN THE CITY, THE INCREMENT ZONE OVERLAYS THE PUBLIC IMPROVEMENT DISTRICT.

THE IDEA WHEN WE SET A BASE VALUE FOR THE TOURS EACH YEAR IS THAT VALUE INCREASES.

THE CITY LEVIES ITS TAX RATE ON THAT PROPERTY LIKE EVERY OTHER PARCEL WITHIN THE CITY, EXCEPT THAT INCREMENT, INSTEAD OF THE FULL AMOUNT GOING INTO THE CITY'S GENERAL FUND, A PORTION, IN THIS CASE 45% OF THAT INCREMENTAL REVENUE IS RESERVED TO PAY DOWN THE ASSESSMENTS WITHIN THIS IMPROVEMENT AREA.

THE GOAL THERE BEING TO MAKE SURE THAT THE ASSESSMENTS, BECAUSE THESE ARE ALL LEVIED AT DIFFERENT TIMES AND DIFFERENT INTEREST RATE ENVIRONMENTS AND ON DIFFERENT PROJECTS AS TO AS MUCH AS POSSIBLE, KEEP THE ASSESSMENTS SIMILAR ON LIKE KIND AND SIMILAR PROPERTIES.

IN THIS CASE.

WE DID SELL BONDS TODAY AND THE PLANS ARE THE SAME AS WHAT APPEARS IN YOUR AGENDA PACKET.

THE ESTIMATED BUILD OUT VALUE OF IMPROVEMENT AREA NUMBER TWO, WHICH IS SUBZONE 62, IS ABOUT 95 MILLION.

THIS MORNING WE HAVE A BID TO UNDERWRITE FROM MS UNDERWRITERS FOR 9,532,000 OF SPECIAL ASSESSMENT REVENUE BONDS AT AN ALL IN TRUE INTEREST COST OF 5.68%.

A LITTLE BACKGROUND ON THE PROJECT.

THIS PROJECT IN TOTAL IS WAS INITIALLY LAND THAT WAS IN ETJ AS PART OF A DEVELOPMENT AGREEMENT NEGOTIATION ANNEXED INTO THE CITY 880 TOTAL SINGLE FAMILY LOTS.

A COMMITMENT TO PAY $1,800 PIT FEE PER SINGLE FAMILY LOT AT THE CLOSING OF THE CORRESPONDING BOND ISSUANCE.

THE PROJECT WE'RE GOING TO BE TALKING ABOUT TODAY IS IMPROVEMENT AREA NUMBER TWO, 256 SINGLE FAMILY RESIDENTIAL LOTS WITH A BUILD OUT OF APPROXIMATELY 95 MILLION.

THEY'LL AT CURRENT AD VALOREM TAX RATE GENERATE ABOUT 420,000 VALOREM TAX, ABOUT 214,000.

AFTER THE TOURIST PARTICIPATION AT THE CLOSING OF THIS BOND ISSUE, THERE WILL BE A ONE TIME FEE OF $460,800 PAID TO THE CITY. THIS HAS BEEN A DEVELOPMENT AGREEMENT THAT'S BEEN IN PLACE SINCE 2020.

THE PID WAS CREATED IN 20 2020 2022.

AND TODAY WE PRICE THE BONDS.

AND TONIGHT YOU HAVE THIS ORDINANCE FOR APPROVAL.

IF APPROVED JEFF GOLDBLUM, YOUR BOND COUNSEL, SUBMITTED TO THE ATTORNEY GENERAL FOR REVIEW AND AND AND APPROVAL.

AND THEN WE'LL CLOSE THIS ON I BELIEVE IT'S NOVEMBER 12TH, AS I INDICATED, $1,800 PER LOT, $460,000 DEPOSITED AT CLOSING.

AND OUR CURRENT TAX RATE, ABOUT 420,000 AND TOTAL TAXES, MINUS THE TOURIST PARTICIPATION, WILL NET US 214,000 DURING THE LIFE OF THE BOND ISSUE. THOSE THAT WE'VE TALKED PREVIOUSLY, WE EXPECT TO REFUND THIS AND REDUCE OUR TOURIST PARTICIPATION DURING THIS TIME FRAME.

WE DID A COMPARISON.

THIS WAS SOME PRICING COMPARISONS SUBMITTED BY THE THE UNDERWRITER THE CITY OF PRINCETON LOUIS STONE SOUTHRIDGE ONE A IMPROVEMENT AREA NUMBER TWO BOND ISSUE WAS THE WAS PRICED AT 165 BASIS POINTS OVER THE MMD 30 YEAR RATE.

IT'S THE LOWEST PRICED BOND THAT WE'VE HAD.

AND AS YOU SEE, COMPARED TO THE COMPARABLES HERE, IT ACTUALLY BEAT PROJECTS THAT WERE IN SOME OF THE OTHER HIGH QUALITY DEVELOPMENTS IN THE STATE OF TEXAS THE CITY OF KYLE, SALINA, OAK POINT AND DRIPPING SPRINGS THAT WERE RECENTLY PRICED.

THEY RANGED FROM 175 BASIS POINTS TO ON AVERAGE.

AND OURS AGAIN WAS THE CHEAPEST PRICE HERE.

IT WAS PRICED WELL BECAUSE IT WAS OVERSUBSCRIBED.

AND AGAIN, THESE BONDS ARE WELL SET UP BY THE INVESTORS.

THE TRANSACTION THIS ACTUALLY IS A SOURCE AND USES OF FUNDS.

$8 MILLION WOULD GO INTO THE PROJECT FUND.

TWO YEARS OF CAPITALIZED INTEREST OR $661,000.

WE PUT IN A DEBT SERVICE FUND.

COST OF ISSUANCE AND INITIAL DEPOSIT INTO THE ADMINISTRATIVE FUND.

THE BOND HAS AN AMORTIZATION OF 30 YEARS, AND THE KEY POINTS FOR THE HOMEOWNERS IS THE ASSESSMENT LIEN WOULD BE 37,234 ON AVERAGE PER PARCEL,

IN SUMMARY, IT'S COMPLIANT WITH THE DEVELOPMENT AGREEMENT.

IT'S STRUCTURED BASED ON THE STANDARD BEST PRACTICE FOR A SPECIAL ASSESSMENT REVENUE BOND IN THE STATE OF TEXAS AND ITS PRICE REALLY EFFECTIVE 165 BASIS POINTS. IT'S CHEAPER THAN ANY OTHER BOND ISSUE WE'VE DONE.

IT'S THE MOST EFFICIENT TRANSACTION WE'VE EVER DONE AND THE MOST EFFICIENT ONE THAT I'M AWARE OF THAT'S BEEN DONE IN TEXAS.

AND AGAIN, A COUPLE OF THINGS I WANT TO POINT OUT TO YOU ON THIS IS THAT THEY HAVE CONTRACTS FOR SALE OF ALL 170 LOTS.

THE VALLEY TO LEAN IS ONLY 3.3 HERE.

I MEAN, IT IS 3.3.

IT'S GOT NOT VERY HEAVILY LEVERAGED.

AND AND MY UNDERSTANDING IS THAT THAT OUR INFRASTRUCTURE IS, IS ALREADY COMPLETE.

SO THIS IS A WELL RECEIVED PROJECT.

NO CONSTRUCTION RISK AND NO ABSORPTION RISK IN A LOW ASSESSMENT RATE BECAUSE OF THE THE SMALLER OVERALL ASSESSMENT.
