TONIGHT, I WANT TO BRING TO ATTENTION TO A GROWING CONCERN FOR MYSELF AND MY NEIGHBORS IN REGARD TO TRAFFIC CONGESTION AND INFRASTRUCTURE STRAIN, PARTICULARLY IN CONNECTION TO ONGOING RESIDENTIAL DEVELOPMENT.
ONE INTERSECTION IN PARTICULAR IS THE BEECHAM ROAD AND COUNTY ROAD 398 LEADING OUT INTO FM 546.
THIS HAS BECOME NOT JUST A PROBLEMATIC, AS YOU'D ALREADY KNOW WITH HIGHWAY 380, BUT BETWEEN LONG LINES OF TRAFFIC, DANGEROUS TURNS AND FREQUENT ACCIDENTS, THIS STRETCH HAS BECOME A DAILY SOURCE OF FRUSTRATION AND GENUINE SAFETY CONCERN.
ON TOP OF THAT, POTHOLES AND DETERIORATING ROAD CONDITIONS ARE DAMAGING VEHICLES AND RAISING QUESTIONS ABOUT MAINTENANCE AND OVERSIGHT.
THIS ISN'T JUST AN INCONVENIENCE, IT'S A SYMPTOM OF A LARGER ISSUE.
PRINCETON IS GROWING, BUT OUR INFRASTRUCTURE ISN'T KEEPING UP.

WHICH BRINGS ME TO THE TOPIC OF THE RESIDENTIAL BUILDING MORATORIUM.I WANT TO EXPRESS MY FULL SUPPORT FOR EXTENDING THE MORATORIUM ON A NEW RESIDENTIAL APPROVEMENT.
HOWEVER, THIS IS NOT BEING ANTI GROWTH.
IT'S ABOUT RESPONSIBLE, MEASURED GROWTH.
WE CANNOT KEEP ADDING ROOFTOPS WITHOUT FIRST INVESTING IN THE ROADS, SCHOOLS, AND EMERGENCY SERVICES NEEDED TO SUPPORT RESIDENTS AND THEIR FAMILIES WHO CALL THIS CITY THEIR HOME.
RIGHT NOW I'M ASKING THAT THE COUNCIL NOT ONLY EXTEND THE MORATORIUM BASED ON THE BENCHMARKS THAT NEEDED TO BE TIED TO A CLEAR FOR INFRASTRUCTURE PROGRESS.
PRIORITIZE UPGRADES TO THE HIGH TRAFFIC INTERSECTIONS ON BEECHAM AND COUNTY ROAD 398, ENSURE THAT EXISTING RESIDENTS, TAX PAYING, INVESTED PEOPLE AND FAMILIES AREN'T LEFT TO DEAL WITH DANGEROUS ROADS AND INSUFFICIENT CITY SERVICES WHILE NEW DEVELOPMENT KEEPS MOVING FORWARD.
MY WIFE AND I, WE LOVE THIS CITY.

MORE RESEARCH HAS REVEALED THAT THE CITY ADOPTED THE WINTER MONTH AVERAGING FEE SCHEDULE ON DECEMBER 12TH OF 2022.

THE CITY ADMINISTRATION DID NOT ENACT A CHANGE.I ASSUME THIS IS WHY THE COUNCIL WENT BACK IN APRIL OF 2023 AND MADE IT A LAW WITH ORDINANCE 2023-04-24.
AS IT HAS COME TO LIGHT, EVEN WITH THE PASSAGE OF THIS LAW, THE CITY STILL CHOSE NOT TO ENACT IT.
THESE FACTS CAN BE VERIFIED BY WATCHING THE DECEMBER 12TH, 2022, AND THE 4-24-2023 COUNCIL VIDEOS.
THE MATTER WAS AGAIN ADDRESSED IN SEPTEMBER OF 2024 WITH THE PASSAGE OF ORDINANCE 2024-091602, WHERE THE WINTER MONTH AVERAGING APPROACH TO WASTEWATER BILLING WAS REMOVED.
THIS VERIFIES THAT AT SOME POINT, THIS CITY ADMINISTRATION BECAME AWARE OF THE ISSUE.
UNFORTUNATELY, INSTEAD OF MAKING IT RIGHT AND REFUNDING OVERCHARGES, THEY OPTED TO COVER IT UP.
FOR THE THIRD TIME SINCE DECEMBER OF 2022, THE CONSULTING COMPANY, NEW JANE, CAME IN AND DISCUSSED THE WATER AND WASTEWATER RATE.
THIS TIME WITH CONFLICTING RESULTS.
IT IS MY BELIEF THAT THEY ADDED THE SLIDE THAT STATES SPECIFICALLY THE CITY'S UTILITY BUDGET DOES NOT INCLUDE A FULL BREAKDOWN OF WATER AND SEWER COST TO KEEP THEM LEGAL.
THIS SITUATION ALONE INVOLVES 2-$3,000,000. WHERE IS IT? ALSO, IT IS STILL NOT CLEAR DO WE HAVE THE FOUND $17 MILLION IN IMPACT FEES OR NOT? WHERE IS IT? WE ARE TALKING $20 MILLION BETWEEN THESE COMPLETELY DIFFERENT CITY DEPARTMENTS WHICH JUSTIFIES A FULL FORENSIC AUDIT OF THE WHOLE CITY.
I'M ASKING FOR AN IMMEDIATE EMERGENCY CITY COUNCIL MEETING TO APPROVE A FULL FORENSIC AUDIT OF ALL DEPARTMENTS AS IS BEING RECOMMENDED BY THE CURRENT CIRCULATION CIRCULATING SAFEGUARD PRINCETON PETITION.
I DON'T WANT TO HEAR ANYTHING ABOUT COSTS BECAUSE THERE'S $20 MILLION OUT THERE.

DESPITE THIS, THE ORDINANCE WAS NOT IMPLEMENTED.
THE EXPLANATION PROVIDING CITING CHANGES IN CITY ADMINISTRATION PERSONNEL IS SIMPLY NOT AN ACCEPTABLE REASON FOR THE CITY'S FAILURE TO ADHERE TO ITS OWN ADOPTED POLICY.
THIS OVERSIGHT HAS LED TO RESIDENTS BEING OVERCHARGED FOR WASTEWATER SERVICES BY NOT APPLYING THE WINTER AVERAGING METHOD DURING THAT PERIOD.
THIS IS NOT MERELY AN ADMINISTRATIVE HICCUP.
IT IS A FAILURE OF PROCESS WITH A CLEAR AND SIGNIFICANT FINANCIAL IMPACT ON OUR COMMUNITY.
IT IS THEREFORE THE MORAL DUTY OF THIS CITY COUNCIL AND ADMINISTRATION TO REFUND RESIDENTS FOR THESE OVERCHARGES INCURRED DUE TO THE NON-COMPLIANCE OF THIS ORDINANCE.
FURTHERMORE, I URGE YOU TO IMPLEMENT ROBUST PROCESSES TO ENSURE SUCH FAILURES OF ACCOUNTABILITY AND IMPLEMENTATION DO NOT RECUR IN THE FUTURE.
SECONDLY, I MUST CHALLENGE THE ASSERTION THAT THE EXISTING 10,000 GALLON PER MONTH CAP ON RESIDENTIAL SEWER PROVIDES ADEQUATE PROTECTION OR IS EQUITABLE FOR PRINCETON RESIDENTS.
FOR A TYPICAL FAMILY OF FOUR, WINTER WATER USAGE AVERAGES AROUND 3,000 GALLONS PER MONTH, IMPOSING A 10,000 GALLON CAP FOR WASTEWATER CHARGES, INSTEAD OF USING TRUE WINTER AVERAGING BASED ON ACTUAL USAGE, UNFAIRLY BURDENS RESIDENTS AND CLEARLY BENEFITS THE CITY'S FINANCES.
THIS DECISION, SEEMINGLY MADE BY THE RATE CONSULTANT DOES NOT APPEAR TO HAVE PRIORITIZED THE FINANCIAL WELL BEING OR FAIRNESS TO US RESIDENTS.
IT IS ABUNDANTLY CLEAR THAT THE WINTER AVERAGING METHOD MUST BE IMPLEMENTED IMMEDIATELY TO ENSURE TRULY EQUITABLE WASTEWATER CHARGES FOR ALL RESIDENTS OF PRINCETON.
IN ADDITION, AS I'VE STATED MULTIPLE TIMES IN THE PAST, THE CITY SHOULD REMOVE THE BASE CHARGE FOR WASTEWATER TO ENSURE FURTHER FAIRNESS TO US RESIDENTS.
I URGE THE CITY COUNCIL TO TAKE SWIFT AND DECISIVE ACTION ON THESE CRITICAL ISSUES. THANK YOU.

WE'RE GOING TO DISCUSS, I HAVE A BRIEF PRESENTATION ON THE MORATORIUM AND THE POTENTIAL SECOND EXTENSION.
AS IT'S TIME TO CONSIDER EXTENDING THE MORATORIUM SET TO EXPIRED, I BELIEVE JULY 12.
I ROLL THROUGH JUST REAL BRIEFLY, A BACKGROUND OF THE MORATORIUM WHEN IT WAS ADOPTED AND THE FIRST EXTENSION THERE TOO, THE PROCESS FOR EXTENDING IT AGAIN, POTENTIALLY, AND THEN THE PROGRESS THAT'S BEEN MADE BY THE CITY UP TO THIS POINT.
THE MORATORIUM ON RESIDENTIAL PROPERTY DEVELOPMENT WAS IMPOSED IN SEPTEMBER OF 2024, IN ACCORDANCE WITH LOCAL GOVERNMENT CODE, CHAPTER 212.
IT APPLIES TO NEW UNENTITLED RESIDENTIAL PROPERTY DEVELOPMENT, BOTH IN THE CITY'S CORPORATE LIMITS AND ETJ.
THE PURPOSE, ESSENTIALLY TO PROVIDE STAFF MORE TIME TO PLAN AND ADDRESS INFRASTRUCTURE AND FACILITY CAPACITY CONCERNS DURING THE CITY'S HIGH-GROWTH PERIOD.
ALSO, FEEL FREE TO STOP ME ANYTIME.
LIKE I SAID, JUSTIFICATION THAT WAS TWO PART.
ONE WAS A SHORTAGE OF ESSENTIAL PUBLIC FACILITIES, WHICH BY LAW IS DEFINED AS WASTEWATER AND ROADWAY, AND THEN A SIGNIFICANT NEED FOR OTHER PUBLIC FACILITIES, NAMELY POLICE.
BY LAW, THE INITIAL MORATORIUM COULD BE FOR 120 DAYS.
THAT WAS SET TO EXPIRE JANUARY 21, OF 2025 UNLESS THE COUNCIL EXTENDED IT.
THEN ON JANUARY 13, 2025, THE MORATORIUM WAS EXTENDED FOR 180 DAYS, AND AS I MENTIONED SET TO EXPIRE ON JULY 12 OF THIS YEAR UNLESS IT FURTHER EXTENDED IN ACCORDANCE WITH APPLICABLE LAW.
NOW, BEFORE YOU THIS EVENING IS ORDINANCE 2025-06-23, THE SECOND EXTENSION OF THE MORATORIUM.

THIS IS, ONCE AGAIN, THE PROCESS AS DEFINED UNDER STATE LAW.WE POSTED A NOTICE OF PUBLIC HEARING IN THE PRINCETON HERALD ON JUNE 5, WHICH WAS AT LEAST 15 DAYS PRIOR TO TODAY'S PUBLIC HEARING.
WE'LL HAVE A PUBLIC HEARING AFTER I'M DONE WITH MY PRESENTATION, AND THEN THE ORDINANCE THAT YOU HAVE BEFORE YOU HAS THE WRITTEN FINDINGS AS REQUIRED BY STATE LAW, IDENTIFYING THE PROBLEMS, REQUIRING THE NEED FOR EXTENDING, DESCRIBING THE CITY'S REASONABLE PROGRESS MADE TO DATE, AND THEN SPECIFYING A DEFINITE DURATION FOR THE RENEWAL PERIOD.
AS YOU'LL NOTICE IN THE ORDINANCE ITSELF, MYSELF AND STAFF ARE RECOMMENDING AN EXTENSION OF 160 DAYS, WHICH WOULD PUT IT FROM NOW ALL THE WAY UNTIL NOVEMBER 30, 2025.
JUST ROLLING THROUGH WHAT I SAID EARLIER, WHEN THE MORATORIUM WAS ADOPTED, IT WAS TWO PART, SHORTAGE OF ESSENTIAL PUBLIC FACILITIES, AND SIGNIFICANT NEED FOR OTHER PUBLIC FACILITIES.
A LOT OF THE CITY'S INFRASTRUCTURE WASTEWATER AND ROADWAYS OPERATING AT NEAR BEYOND CAPACITY.
SOME OF THE REASONABLE PROGRESS THAT THE CITY HAS MADE TO DATE, I HAVE THEM BULLETED RIGHT THERE, SO I'LL JUST MENTION SOME OF THEM.
THE CITY'S WORKING ON UPDATING ITS WATER AND WASTEWATER CAPITAL IMPROVEMENT PLAN, IMPACT FEE STUDY AND PLAN, WATER AND WASTEWATER MASTER AND DRAIN AND DESIGN STANDARDS PLAN, SAFETY MOBILITY ACTION PLAN, ALSO DESIGNING PUMPING CAPACITY IMPROVEMENTS TO ALLOW FOR ADDITIONAL STORAGE, DESIGNING A FUTURE THREE MILLION GALLON ELEVATED STORAGE TANK, AND OTHER PROGRESS MADE BY THE CITY TO DATE TO ALLEVIATE THAT PROBLEM.
SIGNIFICANT NEED FOR OTHER PUBLIC FACILITIES.
THERE'S A NEED FOR POLICE FACILITIES AND PERSONNEL AS THE CITY HAS CONTINUED TO GROW.
TO DATE, SOME OF THE NON EXHAUSTIVE ITEMS THAT THE CITY HAS DONE TO ALLEVIATE THIS PROBLEM IS TO ADOPT A WORKING PLAN AND TIME SCHEDULE TO OVERCOME THE NEEDS BEEN APPROVED TO HIRE ADDITIONAL POLICE PERSONNEL BASED ON AVAILABLE FUNDS, AND STRATEGIZING.
I KNOW CHIEFS BEEN WORKING ON THIS, STRATEGIZING ALTERNATIVE FUNDING SOURCES TO HIRE ADDITIONAL POLICE PERSONNEL.
THAT CONCLUDES MY PRESENTATION.

NOT FOR CERTAIN, BUT I HAVE A FEELING THAT YOU GUYS IN THE CITY MAY HAVE SOMETHING TO PLAY A PART IN THAT.
>> THIS 160 DAYS CAN POTENTIALLY BE THE LAST EXTENSION LEGALLY THAT WE CAN ACTUALLY DO.
IN THIS 160 DAYS, REGARDLESS IF WE CAN EXTEND IT OR NOT.

WE'RE IN THE BEGINNING PHASES OF DESIGNING A THREE MILLION GALLON ELEVATED STORAGE TANK THAT WILL CARRY US WELL INTO THE FUTURE FOR ELEVATED STORAGE.
THEN WE'RE LOOKING AT WRAPPING UP THE CAPITAL IMPROVEMENT AND IMPACT FEE STUDIES AS SOON AS THE COMPREHENSIVE PLAN THAT DEVELOPMENT SERVICES IS WORKING ON COMPLETES THE FUTURE LAND USE ASSUMPTIONS.
AS SOON AS WE RECEIVE THOSE BACK, WE'LL BE ABLE TO WRAP THOSE PLANS UP WITHIN THE NEXT 30-60 DAYS AFTER WE RECEIVE THOSE, AND WE'LL BE ABLE TO ACTUALLY BRING THOSE FORWARD TO COUNCIL FOR ADOPTION AND HAVE THOSE PLANS AVAILABLE FOR FUTURE DEVELOPMENT.

BUT WE HAVE SOME QUICK WINS FOR SOME SAFETY IMPROVEMENTS THAT WE CAN MAKE, WHICH INCLUDE SOME EXISTING ROADWAYS, SOME ROADWAY REALIGNMENTS, ROADWAY EXPANSION, SOME SIDEWALK INSTALLATIONS, THINGS LIKE THAT.
WE'LL BE ABLE TO BRING THOSE FORWARD TO COUNSEL BEFORE THAT PLAN IS READY FOR ADOPTION.
THEN WE'LL BE PARTNERING THAT WITH THE EXISTING PAVEMENT CONDITION ASSESSMENT.
WE'RE MOVING FORWARD WITH SOME OF THE PROJECTS, THE EARLY FINDINGS OF THAT.
WE'RE GOING TO BE BRINGING SOME OF THOSE PROJECTS FOR COUNCIL BEFORE ALL OF THE ROADWAY PLANS AND ALL OF THOSE THINGS ARE READY FOR ADOPTION.
WE'LL HAVE THOSE A LITTLE BIT EARLY AND AHEAD OF TIME.

WE'RE DEALING WITH DECISIONS THAT WERE MADE IN THE PAST, AND WE TRIED; WE PUT THE MORATORIUM IN PLACE TO SLOW THINGS DOWN SO WE CAN DEVELOP THE INFRASTRUCTURE TO ACCOMMODATE THE NEW GROWTH.
WITH THE NEW PROCESSES THAT WE'VE PUT IN PLACE.
WILL THAT SLOW DOWN DEVELOPMENT? WILL THAT HOLD DEVELOPERS TO A MORE STRICTER PROCESS OR PLAN? WILL THEY HAVE TO PROVE MORE TO US BEFORE WE CAN APPROVE THEIR PLANS FOR DEVELOPMENT?

THEY BROUGHT UP EARLIER, BUT A LAKE MEADOWS, I'LL LIKE A UPDATE ON THAT ONE AS WELL ON THE NEXT AGENDA ON JUST IF THERE'S CITY LIMITS OR IF THEY'RE NOT CITY LIMITS BECAUSE THE MAP SHOWS THEM A CITY LIMITS, BUT THEY'RE NOT PAYING TAXES.
