WE KIND OF ASKED FROM THEIR PERSPECTIVE WHO WAS INVOLVED WITH THE THE RENOVATIONS. AND THEN THREE, WE GOT REALLY SPECIFIC WITH WHAT ARE THE SPECIFIC CONCERNS THAT YOU'VE HEARD? WHAT CONCERNS DO YOU HAVE YOURSELF? WHAT HAVE YOU DONE YOURSELF TO CHECK INTO THESE DIFFERENT RENOVATION EXPENDITURES, THINGS LIKE THAT, TO THEN GIVE US STARTING POINTS FOR INVESTIGATION. SPECIFIC CONCERNS AND RUMORS THAT WERE VOICED IN THE INTERVIEW. THERE WAS FOUR MAIN THREADS THAT I WOULD SAY POPPED UP IN MULTIPLE INTERVIEWS. SO ONE WAS THAT CERTAIN PRINCETON STAFF REPRESENTATIVES HELD FINANCIAL INTEREST IN THE VENDORS CHOSEN TO PERFORM THE PHASE ONE RENOVATIONS. TWO THERE IS WAS LITTLE DOCUMENTATION PERTAINING TO VENDOR VETTING AND SELECTION PROCESSES. THAT WAS MADE AVAILABLE TO THE PUBLIC. THREE THE MONEY PAID TO SOME VENDORS SEEMED EXCESSIVE FOR THE WORK PERFORMED, PARTICULARLY SINCE THERE WAS A SECOND ROUND OF RENOVATIONS ULTIMATELY DONE ON THE COMMUNITY CENTER. AND FOUR THERE WERE CERTAIN COMMUNITY CENTER EXPENSES APPEARED TO BE CLASSED UNDER DIFFERENT CITY PROJECTS, ACCORDING TO THE COUNTY RECORDS. HOW THAT LED INTO OUR WORK STEPS AND WHAT WE DID SO RELATED TO PART ONE. WE DID PUBLICLY AVAILABLE RECORDS, REQUESTS AND RESEARCH TO KIND OF DETERMINE IF THERE WAS OVERLAP WITH THE INDIVIDUALS THAT WERE MENTIONED AS BEING POTENTIALLY INVOLVED WITH VENDORS THAT WERE CHOSEN WITH THE RENOVATIONS. ULTIMATELY, THERE WAS NO OVERLAP BETWEEN THE VENDORS WE WERE SEEING IN THE ACCOUNTING RECORDS AND ANY OWNERSHIP INTEREST OF THE PEOPLE THAT WE ENDED UP DOING RESEARCH ON. THAT'S WHY IT WASN'T DISCUSSED DURING THE PREVIOUS PRESENTATION. JUST BECAUSE THERE'S NOT MUCH THAT WE FOUND. THAT WAS TO ESSENTIALLY GIVE US A LOOK INTO EXPENSES AFTER THE THE PHASE ONE RENOVATIONS SPECIFICALLY TO LOOK INTO THAT FIRST CONCERN THAT WAS VOICED IN THE INTERVIEWS AROUND CERTAIN FIGURES HAVING INTEREST IN THE VENDORS CHOSEN FOR THE PHASE ONE RENOVATIONS AND ULTIMATELY THE REPAIRS THAT WERE DONE AFTER THE PHASE ONE RENOVATIONS WHEN IT WAS CLEAR THEY WERE DONE IMPROPERLY. THE THREE OUTSTANDING QUESTIONS THAT WE FOCUSED ON WAS ONE, WAS A FULL FOUNDATION REBUILD RECOMMENDED? TWO, DID THE PRINCETON CITY COUNCIL OFFICIALLY ADOPT THAT SET OF PURCHASING POLICIES AND PROCEDURES THAT WE REVIEWED IN THE PREVIOUS PRESENTATION? AND THREE, WERE BIDS EVER PROPERLY SOLICITED AND OBTAINED REGARDING THE PHASE ONE RENOVATIONS IN THE WORK PERFORMED? TO START, WE'LL GO WITH THE EASY ONE. WAS IT RECOMMENDED THAT A FULL FOUNDATION REBUILD WAS TO BE PERFORMED BY THE ARCHITECTS IN CHARGE OF DESIGNING THE PHASE ONE RENOVATIONS? SHORT ANSWER IS YES. I HAVE A SCREENSHOT HERE FROM THE DESIGN DOCUMENTS THAT JIM PROVIDED TO US SPECIFICALLY ON NOTES ON THE FOUNDATION PLANS. AND REGARDING POINT SIX, WHERE THEY MENTIONED THE INSTALLATION OF NEW PIERS OR REMOVING OF TEMPORARY SHORING AND JACKS. REGARDING THE CITY'S ADOPTION OF PURCHASING POLICIES AND PROCEDURES, THAT'S ALSO A SHORT ANSWER, THE ANSWER IS YES. THEY ADOPTED THOSE ON THE DATE THAT WAS PROVIDED TO US. THAT WOULD HAVE BEEN 2019 OF FEBRUARY. SO THOSE WOULD HAVE BEEN IN EFFECT AS THE VENDORS WERE SELECTED FOR THE PHASE ONE RENOVATIONS. THE SPECIFIC RESOLUTION NUMBER WAS 2019-02-25-R1. THE QUESTION NOW THAT WE KNOW THAT THE PURCHASING POLICIES AND PROCEDURES WERE ADOPTED IS WHETHER IT WAS FOLLOWED OR NOT. SO QUICK OVERVIEW. THIS SHOULD ALSO BE A REVIEW FROM OUR PREVIOUS PRESENTATION. THE POLICIES SPLIT PURCHASES INTO THREE DIFFERENT TIERS BASED ON VALUE. AT TIER ONE THAT 2000 TO $25,000, TIER TWO THAT 25 TO $50,000, AND THEN TIER THREE ANYTHING $50,000 PLUS THE FIRST TWO TIERS DO NOT REQUIRE FORMAL PROJECT SPECIFICATION SHEETS TO BE ISSUED. NOW, THE VENDORS THAT FELL INTO THAT TIER THREE, THERE WERE THREE OF THEM. ONE WAS MIKE ROGERS CONSTRUCTION. THEY SPENT ABOUT $600,000 WITH MIKE ROGERS. TWO WAS DFW FRAMING CONSTRUCTION. THEY SPENT ABOUT $200,000 AND THEN THREE WAS KIMLEY-HORN ASSOCIATES. THEY SPENT ABOUT $90,000. WE'LL WORK OUR WAY DOWN THE LIST. BUT TO START WITH MIKE ROGERS. AGAIN, SHORT ANSWER, IT DOES APPEAR THAT THE CITY DID A FORMAL PROCESS, AND THEY DID OFFICIALLY APPROVE MIKE ROGERS BID TO DO THE WORK. THAT WOULD HAVE BEEN OCTOBER OF 2019. SO SHORT AND SWEET ANSWER THERE. REGARDING DFW FRAMING AND CONSTRUCTION, IT GETS A LITTLE MORE MURKY. IN SHORT, THERE WAS NO EVIDENCE OF A BIDDING RFQ PROCESS THAT WE WERE PROVIDED AND THAT I HAVE SEEN. HOWEVER, IN REVIEWING THE ACCOUNTING RECORDS AND THE AVAILABLE INVOICES AND A SUBSET OF THE CONTRACTS THAT THEY DID WORK UNDER, IT APPEARS THAT DFW FRAMING DID A TON OF WORK IN MULTIPLE SMALLER CONTRACTS THAT ALL FELL BELOW THAT $50,000 THRESHOLD. SO IN AGGREGATE, THEY WERE PAID $200,000. BUT IT APPEARS THERE'S PROBABLY CLOSE TO TEN CONTRACTS THAT THEY DID THE WORK UNDER. WHETHER THAT WAS DONE PURPOSEFULLY TO AVOID THE THRESHOLD, I DON'T KNOW WITH THE EVIDENCE THAT I HAVE RIGHT NOW. BUT AS OF NOW, WE HAVE PROBABLY TWO OF THE CONTRACTS AND THEY ALIGN PRETTY CLOSELY TO THE ACCOUNTING RECORDS THAT WE REVIEWED AS WELL. SO, FOR EXAMPLE THE TWO CONTRACTS WE HAVE ALIGNED ON THE ACCOUNTING ENTRY DESCRIPTION REGARDING THE SCOPE OF THE CONTRACT AND THE DOLLAR VALUE SPECIFICALLY AS LISTED ON THE CONTRACT. SO THAT'S WHY I SAY THERE'S MAYBE TEN PLUS OR -1 OR 2 BASED OFF THOSE ACCOUNTING RECORDS. [00:35:07] FINALLY, WE HAVE KIMLEY-HORN AND ASSOCIATES. KIMLEY-HORN MOST LIKELY WOULD HAVE FALLEN UNDER THESE PROFESSIONAL SERVICES AS ARCHITECTS AND ENGINEERS SPECIFICALLY WITH THE DESIGN AS WELL. SO NO ISSUES THERE. AND THAT'S ALL I'VE GOT. SO ANY QUESTIONS THAT I CAN HELP ANSWER REGARDING ANY OF THESE FINDINGS OR CONCERNS THAT YOU WANT TO EXPRESS? I WANT TO ADD JUST A COUPLE THINGS. BUT I WANT TO EXPLAIN JUST A COUPLE THINGS THAT LEGALLY AND THIS THIS PROJECT WAS NOT DONE THIS WAY BECAUSE IT WAS REALLY RUN BY THE CITY MANAGER AND ASSISTANT CITY MANAGER BUT JUST AS AN FYI, THE EDC AND CDC DON'T HAVE TO FOLLOW THE SAME PROCUREMENT LAWS THAT THE CITY DOES. WE DO HAVE MORE FLEXIBILITY. NOW, IT HONESTLY LOOKS LIKE THIS PROJECT FOLLOWED THE CITY'S PURCHASING POLICY. YOU KNOW, BY LAW, WE DON'T HAVE TO. AND GRANT IF YOU WANT TO VERIFY THAT. WE'VE BEEN TALKING ABOUT A LOT OF THESE THINGS. GET A CHANCE TO, YOU KNOW, THROW SOME CONCEPTS OUT, GET FEEDBACK FROM YOU ALL, GET DIRECTION ON HOW YOU WANT TO PRIORITIZE THINGS AND REALLY HOW YOU.
